Criminal law: frequently asked questions
I have been summoned as a suspect (investigado). What should I do?
Do not attend without a lawyer. Before giving a statement you should know what you are accused of and what is in the case file. You have the right not to make a statement, not to answer every question and to answer only before the judge. Contact us as soon as you receive the summons so we can prepare your statement in good time.
What are my rights if I am arrested?
Among others, the right to be told why you have been arrested, to remain silent, to choose your own lawyer, to have a relative informed and to an interpreter if you do not understand the language. As a general rule, police custody cannot last more than 72 hours before you are brought before a judge.
What is a fast-track trial (juicio rápido)?
It is an accelerated procedure for certain offences, such as many drink-driving cases, some gender-based violence cases and, since April 2025, breaking into a dwelling and unlawful occupation of property. It can take place within a few days. If you plead guilty at the duty court, the sentence can be reduced by a third, but you should assess with your lawyer whether this is in your interest before accepting.
What happens if I fail a breathalyser test?
It depends on the reading and the circumstances. Exceeding 0.25 mg/l in exhaled air (0.15 mg/l for novice and professional drivers) is an administrative offence, with a fine of €500 or €1,000 and the loss of four or six points. The Government has proposed lowering the general limit, but it has not been approved to date. Above 0.60 mg/l in exhaled air, or driving under the influence of alcohol, it is a criminal offence: it can lead to a fine, community service or prison, and loss of the driving licence for one to four years.
Do I need a lawyer to report a crime?
No: a report (denuncia) can be filed at a police station or court without a lawyer. To file a private criminal complaint (querella), or to join the proceedings as a private prosecutor and defend your interests, you need a lawyer and a court representative (procurador).
Do you assist people who do not speak Spanish?
Yes. We work in Spanish, Catalan, English, French, German and Dutch, which is especially useful if the problem arises during a stay in Barcelona or on the Costa Brava.
