When a tenant stops paying or refuses to hand back a home or commercial premises, the landlord needs to recover possession and, where appropriate, claim what is owed. Doing this properly means choosing the right route, preparing the paperwork and meeting the prior requirements laid down by law, which have changed several times in recent months. This guide summarises how evictions work in Barcelona and what to check before taking the first step.
When eviction is possible
Unpaid rent or other amounts owed and the expiry of the lease can justify recovering a home or premises through the courts. Occupation without any legal title requires a different route. Misuse of the property may lead to termination of the contract if the requirements are met; not every case follows the same procedure.
Can an agreement be reached before going to court?
Yes, and it is often the fastest option. The parties can agree a payment plan, a deferral or a date for handing over the keys. A lawyer can handle the negotiation and record the agreement in writing, which also serves as proof of the prior attempt at settlement that the law now requires.
Requirements before filing the claim
You need the lease, proof of ownership or right of possession, details of the debt and any prior communications. In addition:
- Attempt to negotiate (MASC). Since 3 April 2025, Organic Law 1/2025 requires proof of a prior attempt at out-of-court settlement. In October 2025 the civil sections of the Barcelona Provincial Court agreed that, in evictions for non-payment, the payment demand that prevents the tenant from settling the debt in court is not enough: the landlord must also offer a MASC. A simple burofax demanding payment does not meet this requirement on its own.
- Housing and vulnerability details. Since Law 12/2023 on the right to housing, the claim must state whether the property is the tenant’s habitual residence and whether the claimant is a large landlord (gran tenedor). If so, and the tenant is vulnerable, a prior conciliation or mediation procedure before the competent authority must be proved.
- Catalonia. In 2024 the Constitutional Court struck down the Catalan rule obliging landlords to offer social rent before filing certain claims, so it no longer affects new claims. Other regional obligations of large landlords should still be checked.
Non-payment and settling the debt in court (enervación)
In proceedings for non-payment, the claim for rent owed can be combined with rent accruing until possession is actually handed back. Where the tenant may stop the eviction by paying, the amount due must be paid or deposited within the court’s deadline, usually ten days. This is not possible if the tenant has already done so before, save for legal exceptions, or if the landlord sent a reliable payment demand at least thirty days before filing and payment was not made by the time the claim was filed.
Vulnerable tenants: Royal Decree-Law 29/2026
Royal Decree-Law 29/2026, in force since 8 October 2026, introduces new protection measures. It is awaiting validation by Congress, which already repealed two earlier decrees on this subject in 2026, so you should check whether it is still in force when the claim is filed. Among other measures:
- Extraordinary settlement. If the tenant is economically vulnerable, the public authorities have two months to offer alternative housing or pay or deposit the debt. If they do not, they take over as debtor and the lease continues while the vulnerability persists.
- Suspension of evictions until 31 December 2030 in certain cases, with different rules depending on who the claimant is and, in some cases, compensation for the owner.
The conditions and exceptions are complex and depend on who the owner is and on the tenant’s situation, so they need to be assessed case by case.
Unauthorised occupation
The summary procedure for recovering a home, available to individuals, non-profit organisations and public bodies that own social housing, requires checking standing and documentation. Any objection is handled within the corresponding verbal proceedings and does not by itself turn them into ordinary proceedings. On the criminal side, since April 2025 the offences of breaking into a dwelling and unlawful occupation can be tried through fast-track proceedings. The best route depends on the case.
Timescales, representation and damages
Timescales depend on the court, any objection, notifications and possible protection or suspension measures; a duration of three or four months cannot be guaranteed. These proceedings require a lawyer and a court representative (procurador). Compensation for occupation requires proof of its basis and of the loss. Never change the locks or cut off utilities yourself.
If you also want to recover the debt
Outstanding rent can be claimed together with the eviction or separately. If you are only interested in getting paid, see our guide on debt recovery in Barcelona. For contracts, property purchases and other real estate disputes, visit our real estate lawyers in Barcelona and Roses page.
