Meaning and required possession
Usucapión allows ownership or other possessory property rights to be acquired through possession meeting statutory conditions for the required period. Mere use or occupation is insufficient: possession must be as holder of the right, public, peaceful and uninterrupted. Tenancy or mere permission does not itself equal possession as owner.
Periods and applicable law
Under common Spanish law, ordinary acquisitive prescription of real estate requires just title and good faith, with ten years between persons present or twenty between absent persons under the relevant rules. Extraordinary prescription requires thirty years without just title or good faith, but retains possession requirements. In Catalonia the property period is twenty years without title or good faith; possession predating Book Five requires review of transitional rules. Criminal origins and interruption have specific rules.
Evidence and registration
Prove commencement, continuity and capacity of possession through documents and other evidence. A dispute may require a declaratory ownership claim based on usucapión, rather than a simple possessory action to acquire ownership. Acquisition does not always depend on registration; effects against third parties, especially protected registered purchasers, require assessment of land-register rules. Years of occupation alone do not guarantee recognition.
